Terms of Use

These Terms of Use govern your use of Luna and the services provided by The Perimenopause Lab, also known as PM Lab.

By creating an account or using Luna, you agree to these Terms.

Our Privacy Policy explains how we collect, use, protect, retain and disclose personal information.

Our Health Disclaimer explains Luna's medical, health and safety boundaries.

Both form part of your agreement with us.

If you do not agree to these Terms, the Privacy Policy and the Health Disclaimer, please do not use Luna.

Luna is a women's health education, tracking and self-understanding platform.

You can use Luna to talk or type about what you are experiencing, organize health information, track changes over time, explore patterns in your data and create summaries or reports that may help you prepare for conversations with healthcare professionals.

Luna uses artificial intelligence and other automated systems to support these functions.

Luna is designed for education, self-understanding and better healthcare conversations. It does not replace professional healthcare or clinical judgment.

You must be at least 18 years old to create an account or use Luna.

By creating an account, you confirm that you are at least 18 and legally able to agree to these Terms.

Luna is intended for individual personal use unless PM Lab expressly agrees otherwise.

Luna is a Canadian product. If you choose to use Luna from another country, you understand that you are using a Canadian service governed by these Terms and our Canadian Privacy Policy.

You are responsible for your account and for keeping access to it secure.

You agree to provide accurate information where accuracy is necessary for a feature to work properly.

You may not:

• use another person's account;
• allow another person to impersonate you through your account;
• attempt to access another user's information;
• use your account for unlawful or unauthorized purposes.

Contact support@perimenopauselab.com promptly if you believe your account has been accessed without permission.

Luna requires health information to provide its personalized functions and maintain your longitudinal health history.

Your use of Luna is subject to the consent described in our onboarding disclosures and Privacy Policy.

That consent includes:

• processing your health information so Luna can provide personalized functions;
• maintaining your longitudinal health record;
• using de-identified information across Luna users for internal research, exploratory analysis and development of Luna's Intelligence Layer.

These uses are part of Luna's core service.

If you do not provide the required consent, you cannot use Luna.

If you later withdraw that consent, Luna can no longer provide its core service and your account will be closed.

Our Privacy Policy explains how information is collected, used, de-identified, retained and deleted, including what happens after consent is withdrawn.

Luna uses AI and automated systems to organize information, identify patterns, generate explanations, create reports and support other product functions.

AI can misunderstand information or produce content that is incomplete, inaccurate or inappropriate for your circumstances.

Luna-generated patterns, scores, summaries, predictions and other outputs are educational and should not be treated as medical advice, diagnosis, treatment or a prescription.

Do not use Luna as your only source for an important healthcare decision.

Our Health Disclaimer explains these boundaries in detail and applies whenever you use Luna.

Luna may create reports or summaries that you choose to download or share with a healthcare professional.

Reports are generated from information available to Luna and may contain omissions, inaccuracies or interpretations that require professional review.

You decide whether to download, share or use a report.

A Luna report does not replace a healthcare professional's independent assessment or clinical judgment.

Luna may help you identify practitioners, products or services that appear relevant to information, goals or preferences you have shared.

These are recommendations to consider.

PM Lab does not guarantee the availability, suitability, quality, safety or outcome of an independent practitioner, product or service.

Practitioners and third-party businesses remain independent of PM Lab unless we expressly state otherwise.

You are responsible for reviewing the information that matters to your decision, including professional credentials, scope of practice, product information, warnings and other relevant details.

Our Health Disclaimer contains the more detailed health and safety limitations that apply to recommendations.

Some practitioners, products or services may have a commercial relationship with PM Lab.

For example, PM Lab may receive an affiliate commission from a purchase, or a practitioner may pay for enhanced visibility.

Commercial relationships will be disclosed where appropriate or required.

Payment does not guarantee recommendation and does not override Luna's relevance, evidence or safety rules.

You retain ownership of the original information and content you provide to Luna.

You give PM Lab the permissions reasonably necessary to operate Luna in accordance with these Terms and our Privacy Policy.

This includes permission to collect, store, process, organize and analyze information where required to provide and improve the service.

These permissions do not transfer ownership of your personal information to PM Lab.

Please do not submit another person's personal or health information unless you have the right and appropriate permission to do so.

Luna's technology, systems and intellectual property belong to PM Lab or its licensors.

This may include:

• software and source code;
• interfaces and designs;
• branding and trademarks;
• health ontologies and classification systems;
• scoring methodologies;
• algorithms and model architecture;
• prompts and AI workflows;
• recommendation systems;
• reports and report structures;
• databases and database structures;
• proprietary content and methods.

Using Luna gives you a limited, personal, non-transferable right to use the service lawfully.

It does not transfer ownership of Luna's technology, systems, methodology or intellectual property to you.

You agree not to:

• use Luna for unlawful purposes;
• access or attempt to access another person's account or information;
• impersonate another person;
• submit information you do not have the right to submit;
• interfere with Luna's security, infrastructure or operation;
• circumvent payment, account, usage or security controls;
• introduce malware or harmful code;
• overload, disrupt or attack the service;
• systematically scrape or extract Luna content or data without authorization;
• reverse engineer protected Luna systems except where applicable law expressly permits it;
• use Luna's proprietary content, datasets, systems or outputs to build or train a competing product without authorization;
• present Luna-generated information as medical advice, diagnosis, treatment or a professional medical opinion.

We may restrict, suspend or terminate access where we reasonably believe an account is being used unlawfully, creates a security risk, harms another person, or materially violates these Terms.

Some Luna services may be free. Others may require a subscription, credits, individual purchases or another form of payment.

Before you complete a purchase, we will show the applicable price and material payment terms.

Applicable taxes may be added where required by law.

Payments may be processed by third-party payment providers. Their own terms and privacy practices may apply to information they process.

If Luna offers a recurring subscription, we will disclose the price, billing frequency, renewal terms and cancellation process before you subscribe.

If a subscription renews automatically, that will be disclosed before purchase.

Cancelling a subscription normally stops future renewal charges. It does not automatically refund a completed billing period unless required by law or stated otherwise at the time of purchase.

Refund eligibility will be explained in the applicable purchase terms.

Nothing in these Terms limits consumer rights that cannot legally be waived.

We may send communications necessary to operate your account, including:

• login or verification codes;
• security notices;
• account notices;
• billing or subscription notices;
• material changes to Luna or these Terms;
• reminders or messages you specifically request.

Marketing communications are separate.

If you choose to receive marketing, research updates, offers or promotional messages, those communications are subject to applicable consent and unsubscribe requirements.

You may unsubscribe from marketing without losing essential service communications.

Luna relies on third-party technology and services to operate.

Some Luna features may also link to independent practitioners, websites, products or services.

PM Lab does not control independent third-party services and is not responsible for their content, availability, security, policies or conduct.

Your use of those services may be governed by separate terms and privacy policies.

Luna will evolve.

We may add, modify, suspend or discontinue features, technical systems, AI models, interfaces, recommendations, pricing or functionality.

Where a change materially affects your rights, paid access or obligations, we will provide notice where required.

We may update these Terms when Luna, our legal obligations or our business practices change.

The date at the top will show the most recent update.

If a change materially affects your rights or obligations, we will provide reasonable notice and obtain renewed agreement where required by law.

Changes apply prospectively from their effective date.

Luna is provided on an "as is" and "as available" basis to the extent permitted by law.

We work to make Luna useful, reliable and secure.

We do not guarantee that:

• Luna will always be available or uninterrupted;
• every feature will operate without error;
• AI-generated information will always be accurate;
• transcriptions will always correctly capture what you said;
• Luna will identify every relevant pattern;
• predictions or reports will always be complete;
• practitioner or third-party information will always be current.

Nothing in these Terms excludes warranties, statutory protections or consumer rights that cannot legally be excluded.

To the maximum extent permitted by law, PM Lab and the people working on its behalf will not be liable for indirect, incidental, special, exemplary, punitive or consequential damages arising from or relating to your use of Luna.

This may include loss arising from reliance on Luna-generated information, reports, recommendations, service interruptions, data loss or independent third-party services.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

To the extent permitted by law, you are responsible for losses, claims or expenses reasonably incurred by PM Lab because of:

• your unlawful use of Luna;
• intentional misuse of the service;
• violation of another person's rights;
• a material violation of these Terms.

This provision does not apply where prohibited by applicable law.

You may stop using Luna at any time.

You may close your account or request deletion of your data using available account controls or by contacting support@perimenopauselab.com.

Withdrawing the consent required for Luna's core service will result in account closure.

Account closure and data deletion are separate actions. Our Privacy Policy explains what happens to personal information after account closure or a deletion request.

PM Lab may also suspend or terminate access where reasonably necessary because of:

• material violation of these Terms;
• fraud or abuse;
• unlawful activity;
• security threats;
• significant risk to users or Luna;
• a legal requirement.

If a court or other competent authority determines that part of these Terms cannot be enforced, the remaining provisions will continue to apply to the extent legally possible.

If PM Lab does not enforce a provision immediately, that does not waive the right to enforce it later.

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there.

Subject to rights available under mandatory consumer, privacy or other applicable law, disputes relating to these Terms will be handled by the courts of Ontario.
